Apr 28, 19:00 FACTS FOUND:
1) Huge and Sail On, two Catalina 30's where sailing in the racing area for race 1 of the SBYC Friday Night Series.
2) The preparatory signal had not yet been made for Huge or Sail On.
3) Huge was reaching on starboard tack for two minutes at 7kts boat speed.
4) Sail On was reaching on a port tack converging course.
5) At one boat length separation Huge changed course away from Sail On.
6) Contact occurred between Sail On's bow and the port side of Huge about two thirds the entire length of Huge.
7) Huge sustained damage to her toe rail, hull fiberglass and four stanchions were damaged. One crew also sustained a bruise and a sprain.
8) Sail On sustained damage to her bow including her pulpit being bent back to the jib furler.
9) The race committee abandoned the race.
10 Neither boat sailed in the re-sailed race one week later. |
CONCLUSIONS AND RULES THAT APPLY:
1) Sail On was on port tack, required by rule 10 to keep clear and failed to do so.
2) Sail On was required by rule 14 to avoid contact and failed to do so.
3) Realizing Sail On would not keep clear, Huge attempted to avoid contact but was unsuccessful in doing so.
4) Sail On broke rules 10 and 14.
5) Huge broke no rules.
6) Because the preparatory signal had not been made for either boat, neither boat was racing (Part 2 Preamble).
7) Because neither boat was racing, nor broke rule 24.1, the protest committee cannot penalize either boat (Part 2 Preamble). POSTED: Apr 29, 17:01 |
