This program is designed to provide High Schools in the Houston area with the facility and coaching needed to manage their teams. Schools with critical number of sailors will work on improving their existing teams while smaller schools will have an opportunity to develop their sailors while cooperating with members of other smaller size programs.

Health protocols regarding sick sailors and staff members:

• Lakewood Yacht Club protocols for screening of staff shall apply to all Bay Access staff.

• Isolate staff and sailors exhibiting new or worsening signs or symptoms of possible COVID-19.

• Testing positive for COVID-19:

o Immediately isolate any sailor or staff member who tests positive for COVID-19.

o If a staff member tests positive for COVID-19, the sailing director or club manager should notify parents or guardians of possible exposure to a lab-confirmed case of COVID-19.

o If a sailor tests positive for COVID-19, sailor’s guardian or parents shall contact Coach Duffy and Coach Duffy will contact the sailors with whom the positive sailor sailed with at the most recent practices. Coach Duffy will maintain a written record of sail pairings at practice.

• Do not allow staff or sailors with the new or worsening signs or symptoms of COVID-19 to return until current CDC criteria have been satisfied (as of Sept 1 2020, the following are the CDC guidelines):

o In the case of a staff member/sailor who was diagnosed with COVID-19, the individual may return to work when all three of the following criteria are met: at least 3 days (72 hours) have passed since recovery (resolution of fever without the use of fever-reducing medications); and the individual has improvement in symptoms (e.g., cough, shortness of breath); and at least 10 days have passed since symptoms first appeared; or

o In the case of a staff member/sailor who has symptoms that could be COVID-19 and does not get evaluated by a medical professional or tested for COVID-19, the individual is assumed to have COVID-19, and the individual may not return until the individual has completed the same three-step criteria listed above; or

o If the staff member or sailor has symptoms that could be COVID-19 and wants to return before completing the above self-isolation period, the individual must obtain a medical professional’s note clearing the individual for return based on a COVID19 test and an alternative diagnosis.

o Individuals may not be in a group larger than 10 individuals. Within these groups, individuals should, to the extent possible, minimize in-person contact with others not in the individual’s household. Minimizing in-person contact includes maintaining 6 feet of separation from individuals. When maintaining 6 feet of separation is not feasible, other methods should be utilized to slow the spread of COVID-19, such as washing or sanitizing hand frequently, and avoiding sharing utensils or other common objects.


Health protocols for High School Sailing Practice:

• If the weather does not permit sailing, there will be no practice. Coach Duffy will make that determination and communicate it to team leaders. Team leaders are responsible to disseminate any practice cancellations to their team participants.

• Pre- and post-practice briefs and debriefs shall be conducted outside, either on the Seahorse sailing center deck or if too crowded and unable to be properly socially distanced, in the grass in front of the FJ dock.

• No more than one team (2 persons) at a time in the FJ sail locker.

• A minimum of 6 feet of distance between all persons at all briefs and debriefs must be maintained.

• Boat rigging shall be conducted in socially distant manner.

• Masks must be properly worn during boat rigging.

• Masks must be worn during double handed sailing until such time as US Sailing modifies its recommendation that masks be worn while sailing.

• Should a sailor fall in the water, he /she should remove his / her mask.

• Sailors may not enter into the Seahorse Lounge other than to use the restroom.

• Sailors are encouraged to wash hands before and after sailing.

• Coach Duffy will endeavor to group sailors into cohorts – groups of 6-8 people who can sail together at practices - in an effort to help define contract tracing efforts.

• Coach Duffy will maintain a written record of pairings of sailors at each practice.

Failure to comply with the foregoing protocols may result in a sailor’s suspension from the High School Sailing Program and no reimbursement will be provided in such event.

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Bay Access Sailing/Lakewood Yacht Club has put in place preventative measures to reduce the spread of COVID-19; however, Bay Access Sailing/Lakewood Yacht Club cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending Bay Access Sailing/Lakewood Yacht Club events could increase your risk and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending participating in the Bay Access High School Sailing program and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Lakewood Yacht Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Bay Access/Lakewood Yacht Club employees, volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance and participation in the Bay Access High School Sailing practices and programs (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Bay Access Sailing/Lakewood Yacht Club, its employees, agents, representatives and independent contractors, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Bay Access/Lakewood Yacht Club, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Bay Access/Lakewood Yacht Club program.
