Registration for Lakewood Yacht Club : 2024 Shoe Regatta

1. Monohulls racing in a PHRF fleet must be on the current PHRF-GB valid list or provide a new certificate; a digital copy of the new certificate should be obtained from the PHRF secretary and uploaded to the boat’s registration. Multihulls shall upload a digital copy of a current rating certificate obtained from Texas Offshore Multihull Association. Monohulls racing in an ORC fleet must have a current ORC rating certificate. A digital copy may be obtained from the Offshore Racing Congress (ORC.org) 2. A waiver is required for each Crew member. A link to the waiver may be found via LakewoodYachtClub.com on the Regatta Information menu. 3. Please provide an emergency contact who is not participating in the race. 4. You must list each of your crew members on the registration form.

WAIVER AND RELEASE OF LIABILITY

1. I recognize that sailing is an activity that has an inherent risk of damage and injury associated with it. I have read Racing Rule of Sailing #3, Decision to Race, of The Racing Rules of Sailing and hereby acknowledge and agree that I am participating in this event entirely at my own risk.

2. I acknowledge and agree that neither Lakewood Yacht Club, Bay Access, Inc., the Race Committee, the race sponsors, the Protest Committee, or their respective members, officers, boards of directors, staff or representatives, will be responsible for

a. any damage to the entered boat or my other property, or

b. any injury, including death,

sustained as a result of my participation in this event, regardless of the fact that such damage may, in whole or in part, be due to the negligence of Lakewood Yacht Club, Bay Access, Inc., the Race Committee, the race sponsors, the Protest Committee, or their respective members, officers, boards of directors, staff or representatives.

3. To the fullest extent permitted by law, I hereby WAIVE any rights I may have to sue the Race Organizers (including Lakewood Yacht Club, Bay Access, Inc., the Race Committee, the race sponsors, the Protest Committee, and/or their respective members, officers, boards of directors, staff or representatives) with respect to personal injury or property damage suffered as a result of my participation in this event and hereby RELEASE the Race Organizers from any liability for such injury or damage to the fullest extent permitted by law whether caused in whole or in part by negligence.

4. I have taken all necessary steps to ensure that I and the entered boat are adequately prepared for all possible contingencies, including appropriate safety equipment as may be required by law or that a prudent seaman would consider advisable.

5. PHOTOGRAPHERS AND MEDIA RIGHTS On behalf of myself, my crew, the vessel owner if someone else, and each of our guests who participate in the racing or shoreside events related to the Regatta grant Bay Access, Lakewood Yacht Club and their sponsors the irrevocable and unrestricted right and permission in perpetuity, to use my and their name, image or likeness and that of my or their vessel for editorial, promotional, educational or race reporting purposes in any and all forms of media, including, but not limited to TV, movie, videos, newspapers, magazines, periodicals, and any electronic form of the internet, or like or similar media.

6. I understand this document has important legal consequences and have consulted such legal and other advisors as I deem appropriate before signing.
