WAIVER/PARTICIPATION IN REGATTA

I hope you are excited to participate in the Norfolk Yacht and Country Club Regatta Program. We hope you have a great time! We want to make sure you understand that there are certain risks that are inherent to a Regatta, being on the water, and being outdoors in the weather. Accordingly, by entering into the Regatta, you are voluntarily assuming the risk of personal injury or death from any of the following.

1. Adverse weather including gusts, shifting wind directions, tides, and wakes from other boats which could cause the boat to act unpredictably or be unable to be controlled or cause the boat to overturn or sink or cause the sail and spars to act wildly.
2. Failure of boat equipment such as rudders, rigging, lines or other equipment which can cause loss of control of the boat or result in being hit with components of the boat.
3. Other persons operating any type of boat improperly causing collision or injury.
4. Slippery conditions when entering/exiting the boat or when launching or hauling the boat from water, such as slime on rocks, boat ramps or other surfaces that are slick.
5. Thunderstorms, tornadoes or other violent weather. You understand that weather forecasts can be wrong, and even if they are correct, in one particular location the weather may be acceptable but a short distance away the weather may be adverse, or the weather may change in a very short time.
6. Impact with foreign objects in the water or submerged in water or with the bottom of the river.
7. Risks of towing and tow lines, including but not limited to speed of tow, risk of the boat overturning, or lines from other boats in tow.
8. Exposure to sunburn and/or dehydration.

In addition to the above risks, you understand that due to the current COVID-19 virus, you may be exposed to or infected by COVID-19 by attending the Regatta. You understand that you run that risk any time you are exposed to others since they may become infected and show no symptoms. While the Regatta may take steps to reduce the risks, there is no way to completely eliminate the risk and still conduct the Regatta.

Accordingly, by participating in the Regatta, you agree to waive any and all claims against Norfolk Yacht and Country Club from any of the risk factors listed above.

By your signature below, the participant, and or the parent or guardian of a participant, agrees that they have fully discussed each of the risks with the participant and agrees that the participant is voluntarily assuming each of the risks described above, and the Participant and Parent or Guardian hereby agrees to waive any claim on their own behalf or on behalf of their child with respect to any illness, damage, loss, liability or expense that may occur in connection with attendance at the Norfolk Yacht and Country Club or participation in the Regatta.
