RELEASE OF LIABILITY AND WAIVER
Sailing is an activity that has an inherent risk of damage and injury. Competitors in this event are participating entirely at their own risk. See RRS 3, Decision to Race.
The race organizers (Navy Yacht Club San Diego, its organizing authority, race committee, protest committee, host club, sponsors, or any other organization or official) will not be responsible for damage to any boat or other property or the injury to any competitor, including death, sustained as a result of participation in this event. By participating in this event, each competitor agrees to release the race organizers from any and all liability associated with such competitor’s participation in this event to the fullest extent permitted by law.
To the fullest extent permitted by law, I hereby waive any rights I may have to sue the race organizers (organizing authority, race committee, protest committee, host club, sponsors, or any other organization or official) involved with the event with respect to personal injury or property damage suffered by myself or my crew as a result of our participation in this event and hereby release the race organizers from any liability for such injury or damage.
In entering this regatta and while participating therein, decisions and actions taken by me as to the operation of my boat, its handling, storage, or hauling and the conduct and safety of my crew are solely my responsibility and will be based solely on my own knowledge, information, observations, and experience and my obligations under pertinent laws, rules, decisions, and regulations. I confirm that I will place no legal reliance on any information furnished me by the Navy Yacht Club San Diego, its officers, agents, committee persons or members or guests assisting committee persons, including information such as weather predictions, courses to be sailed, navigational hazards, tides, currents, or shoals or the proper safety equipment or measures to be followed relative thereto.
