All participants of any SHYC on-the-water event (skipper, crew, students, etc.) must sign one liability form per person per season.
Stonington Harbor Yacht Club, Inc. (“SHYC” or “Yacht Club”) is a Connecticut nonstock corporation which
owns and operates a yacht club, including clubhouse and related facilities located at Stonington Commons, Water
Street, Stonington, Connecticut, and leases and/or owns docks, dock space, storage facilities, moorings, and boats at
Stonington Commons and in Stonington Harbor (collectively, the “Facilities”). The Yacht Club conducts and/or
sponsors a variety of social, athletic, and other events and activities throughout the year at one or more Facilities, on
the waters of Stonington Harbor, and otherwise through SHYC employees and volunteers, from time to time, and
informs its members and others of the opportunity to engage persons independent of SHYC for sailing or boating
instruction which may or may not involve use of Facilities, from time to time (an “Event” or “Events”).
I understand that sailing or boating Events in particular carry with them special risks, including the risk of
personal injury (including death) and property damage. I have disclosed below any personal infirmities of which I
believe SHYC should be made aware. Any sailing or boating vessel and/or its equipment I supply for use by myself
or others in connection with any Event or otherwise, are and will be in sound condition and all required safety gear is
and will be on board, accessible and operable.
In exchange for the Yacht Club allowing me to participate in any Event or Events, including (without
limitation) the event referred to below, I (for myself and my heirs and assigns) waive any and all claims, and release
and discharge the Yacht Club and its officers, directors, trustees, employees, agents, volunteers, and other
representatives and other persons associated with the Event (collectively, the “Event Providers”) from any liability
or claim for personal injury or property damage that I may sustain related to such participation, whether caused by my
own action or inaction, that of any third party, an Act of God, or an Event Provider or Providers, to the greatest extent
permitted by law.
This Liability Waiver Form may be delivered by fax, email, hand or otherwise, and is effective upon receipt.
Any portion of this Waiver Form deemed invalid will not affect the validity of the remaining portions of this Form.
My participation in any Event or Events, and my entry into this Liability Waiver, including assumption of all risk of
personal injury and property damage, is free and voluntary on my part.
