Organizer ("Organizer"): Palm Beach Sailing Club & Youth Sailing Foundation of the Palm Beaches
Program/Event: Palm Beach Offshore C420 Regatta
Location: Lake Worth Lagoon and/or Near shore waters off Palm Beach
Dates of Participation: March 28-29, 2026

1) Assumption of Risk — Open Ocean/Coastal Sailing
I understand that ocean and coastal sailing (including related shore and dock activities) involve inherent risks, including but not limited to: strong currents, tides, surf and shore‑break, steep chop and swells, wakes from other vessels, limited visibility, changing weather (including thunderstorms and lightning), capsize, collision, entanglement, propellers, slips and falls, equipment failure, remoteness from definitive medical care, hypothermia and heat illness, sun exposure, dehydration, and marine life. These risks may be present during rigging/derigging, launching/landing from beaches or ramps, being towed, training/racing, and transportation on coach boats or road vehicles. I voluntarily assume all such risks on behalf of my minor participant. Initial: ________
2) Water Competency, Fitness & Safety Equipment
I represent that my minor participant is physically able to participate and: (a) can swim at least 50 yards continuously and tread water for 5 minutes without a flotation device; (b) will wear a properly fitted, U.S. Coast Guard‑approved life jacket (Type III or V) at all times on docks and while on the water; and (c) will use sun protection and stay hydrated. I agree to notify Organizer in writing of any condition affecting participation. Initial: ________
3) Rules, Instructions & Conduct
We agree to follow all Organizer rules and coach instructions, including safety briefings, weather and the Palm Beach Sailing Club (PBSC) Lightning Protocol (30/30 rule), and US Sailing/US Center for SafeSport policies as applicable. The participant will act respectfully toward coaches, volunteers, teammates, officials, other water users, and the public; no alcohol, drugs, vaping, or harassment. Failure to comply may result in removal without refund. Initial: ________
4) Medical Authorization & Emergency Care
I authorize Organizer’s staff/volunteers to render first aid, arrange transport, and seek emergency medical/dental treatment for my minor participant if needed, including evacuation by EMS or water/aircraft when, in their judgment, time or conditions require. I accept financial responsibility for any resulting costs. I consent to Organizer sharing relevant health information with staff strictly for safety. Initial: ________
5) Release of Liability & Waiver of Claims
To the fullest extent permitted by law, I, for myself and the minor participant, our heirs and assigns, release and waive any and all claims, demands, actions, or causes of action against Palm Beach Sailing Club & Palm Beach Community Sailing Foundation, Inc., its officers, directors, employees, coaches, contractors, volunteers, agents, sponsors, venue owners/lessors, and affiliated organizations (collectively, the “Released Parties”) arising out of ordinary negligence of the Released Parties in connection with the Program, including but not limited to exposure to hazards described above. This waiver does not release claims of gross negligence, willful or wanton misconduct, or rights that cannot be waived by law. Initial: ________
6) Indemnification & Hold Harmless
To the fullest extent allowed by law, I agree to defend, indemnify, and hold harmless the Released Parties from and against any third‑party claims, liabilities, damages, costs, and reasonable attorneys’ fees arising from the minor participant’s acts or omissions, or my own, in connection with the Program. Initial: ________
7) Property & Equipment Responsibility
I accept responsibility for loss of or damage to Organizer equipment caused by willful misconduct or misuse by the participant and agree to reimburse actual repair or replacement costs up to $2000 per incident. Organizer is not responsible for personal property lost, stolen, or damaged. Initial: ________
8) Transportation & Supervision
I give permission for the participant to be transported by Organizer (road vehicles, trailers, and coach/safety boats) for training, launches/recoveries, regattas, and emergencies. I understand supervision may vary during independent rigging/derigging or shore breaks consistent with program norms. Initial: ________
9) Weather, Lightning & Program Changes
Organizer may alter schedules, restrict areas of operation, or cancel/postpone sessions due to weather, sea state, staffing, maintenance, or safety concerns. I understand refunds/credits, if any, will follow the Program’s posted policy. Lightning Policy: The Program follows the Palm Beach Sailing Club (PBSC) Lightning Protocol based on the "30/30 rule" and local guidance; at first indication (lightning/thunder), all boats clear the water and operations pause until conditions meet the return-to-play standard as directed by coaches. Initial: ________
10) Media Consent (Optional)
☐ I grant ☐ I do not grant Organizer the right to capture and use the participant’s name, likeness, image, voice, and biographical information in photos/video for program documentation and non‑commercial promotional purposes in print, web, and social media without compensation. 11) Insurance & Financial Responsibility
I represent that the participant has health insurance or that I accept full financial responsibility for medical expenses arising from participation. I understand that Organizer does not provide accident/medical insurance for participants. Initial: ________
12) Dispute Resolution; Governing Law; Venue
This Agreement is governed by the laws of Florida without regard to conflicts principles. Venue for any action shall lie exclusively in the state or federal courts located in Palm Beach County, Florida. At Organizer’s election, disputes (other than emergency injunctive relief) may be submitted to mediation and, if unresolved, to binding arbitration administered by as designated by Palm Beach Sailing Club under its youth sports/commercial rules; judgment on the award may be entered in any court of competent jurisdiction. If any part is found unenforceable, the remainder stays in effect. Initial: ________
13) Entire Agreement; Acknowledgment
I have read and understand this Agreement, had the opportunity to ask questions, and sign it voluntarily with the intent to be legally bound. This document is the entire agreement regarding its subject; it supersedes prior representations except emergency medical forms and posted policies incorporated by reference.

Safety Addendum (attach to packet)
PFD: USCG‑approved, worn at all times on docks/afloat.
Footwear: Closed‑toe on docks/boats.
Weather: Follows Palm Beach Sailing Club (PBSC) Lightning Protocol (30/30 rule) and local guidance; immediate clearing of water at first indication per coach.
Hydration/Sun: Water bottle required; hat, sunscreen, rash guard recommended.
Communication: Parents must keep phone/email current for time‑sensitive updates.
