Facts found: - This incident occurred during Race 1 of the Second Series of Wednesday Night Racing. - Xiberger is 38 feet long, Hall Pass is 26 feet long - The wind was approximately 5 knots with corresponding seas - Hall Pass was approaching Mark N8, on port tack, N8 was to be left to port. - Xiberger was on starboard tack fetching the mark. - Hall Pass tacked to Starboard, and when she completed her tack she was 2.5 boat lengths from the mark and 20 feet in front of Xiberber -in tacking starboard, Hall Pass passed head to wind in the zone. - Xiberger then established an overlap to leeward of Hall Pass - Hall Pass continued her course without altering helm after Xiberger established the overlap. - Xiberger hit the mark 6 feet from her bow on the port side. - Contact with the mark caused damage to Xiberger at the point of contact. - There was no contact between the boats. Conclusions: -The zone applicable to this situation was 3 of Hall Pass’ boat lengths. - After Hall Pass passed head to wind in the zone, she was obligated to give Xiberger mark room when Xiberger established an overlap to leeward. - Hall Pass failed to give Xiberger mark room, breaking rule 18.3. - Xiberger broke rule 31 when she hit the mark, but is exonerated pursuant to rule 21. Decision Hall Pass is disqualified from Race 1, Series 2. Hall Pass 2609 Disqualified

Facts Found:
Wind was 6 to 8 knots, with corresponding seas
Boats were approaching mark R4 on port tack under spinnaker, mark to be rounded to starboard
When the entered the zone Shamrock was overlapped inside and to leeward of Gunsmoke.
Gunsmoke gybed to starboard as she passed the mark.
Shamrock gybed inside of Gunsmoke
Shamrock was at least a boat width from the mark and a boat length from Gunsmoke
There was no contact between the boats or with the mark
Conclusions:
When Gunsmoke gybed to starboard she became right of way boat. Rule 10
Shamrock was entitled to mark room, 18.2(b)
Gunsmoke gave Shamrock sufficient “ room to round the mark as necessary to sail the course.”
Shamrock kept clear of Gunsmoke
No rule was broken.
