Facts:
Boats were approaching the first weather mark in Race 4 for Fleet 2, AYC Fall Series (3d race Saturday Oct. 17.)
J/70 498 Windriver, on starboard tack, near the starboard layline could not fetch the mark.
Windriver tacked to port, inside the zone and eventually passing within half a boat length of the mark.
When Windriver tacked, J/70 220, Bat VI was already on port. When Windriver completed her tack to port, Bat VI was roughly half a boat length behind Windriver, on a course slightly to leeward, and sailing faster than Windriver
Windriver sailed two boat lengths past the mark on port tack.
While in the zone, Windriver and Bat VI both tacked to starboard to fetch the mark, Bat VI began her tack slightly before Windriver. Bat VI completed her tack before Windriver
At the time Windriver completed her tack Bat VI had an over lap four to six feet.
Upon complotting their tacks, both boats fell off on course to the offset mark, however Windriver sailed a lower course than Bat VI.
After both yachts has passed the mark, contact occurred between the starboard side of Bat VI forward of the mast and the stern quarter of Windriver. There was minor damage to each yacht.
Discussion and conclusions:
When the boats completed their tacks to starboard Bat VI had an overlap to leeward and was entitled to mark room. Windriver game Bat VI adequate mark room. Thereafter, Bat VI was the leeward boat and Windriver was obligated to keep clear, pursuant to Rule 11. Windriver failed to keep clear infringing Rule 11. However, Bat VI was able to alter helm to leeward to avoid contact but failed to do so, infringing Rule 14.
Ruling:
Windriver is disqualified for infringing Rule 11
