CONCLUSIONS AND RULES THAT APPLY:
1) Boat #209 was equipped with a Tacktick T070 in race 5 and 6. It was possible for her to be equipped
with a Tacktick T060.
2) RRS 78.1 requires a boat to comply with class rules while racing.
3) Shields Class Rule (CR) Section III, 1.3 states that use of an item of equipment not expressly
permitted is prohibited (closed class rule). 4) CR Section IV, 9.6 permits the use of electronic compasses without wind shift detection, and
separately, expressly allows Tacktick Model T060, which may have wind shift detection.
5) CR Section IV, 10.9 prohibits electrically powered devices. The Model T070 is electrically powered
and not included in the list of exclusions of that sub-section.
6) The protest committee is in doubt about the meaning of CR III 1.3, IV 9.6 and IV 10.9 and will refer
questions regarding the Model T070 to the Shields Class Association.
7) The Model T070 is not an allowed device under class rules (class letter attached).
8) CR Section III 1.3 prohibits the use of the T070 (as confirmed in a Shields Class letter)
9) Boat #209 did not comply with her class rules in race 6 and 7 and broke RRS 78.1. |
DECISION:
1) The Protest Committee will act under RRS 64.3(b)
2) Boat #209 is disqualified in race 6 and 7.
