R5. wind 080, 17-20 kts. As the boats entered the zone for leeward mark rounding, BER 392 was inside and overlapped with BER 105. As the boats rounded the mark BER 392 was ahead of BER 105 with her (BER 392) spinnaker still up. BER 105's bow sprit became overlapped to leeward of BER 392 whilst BER 392 was attempting to drop her spinnaker. BER 105's boat sprit was not yet full retracted. There was contact between BER 105's bow sprit and the wheetl & pushpit of BER 392, and hull contact between waterline at the bow of BER 105 resulting in damage. BER 392 retired from the race.
Conclusions & Rules that apply:
BER 392 was initially clear ahead boat when BER 105 established an overlap to leeward of BER 392. BER 392 became the give-way boat. BER 105 was obliged to give BER 392 room to keep clear, which she failed to do so. BER 105 broke RRS 14 & 15 & definition of 'room'. BER 392 broke RRS 11, but is exonerated under RRS 21 |
